SC annuls second petition on use of Nepal Army

KATHMANDU, Sept 4: The Supreme Court on Friday annulled the writ petition that demanded scrapping of the provision of Local Administration Act that allows using Nepal Army in 'aid of civil authority.'

Responding to writ petition filed by Advocates Roshan Kumar Jha and Yam Kumar Yonjan, a single bench of Justice Sushila Karki stated that the court has already addressed the issue and struck down a previous petition filed by the same petitioners.
Jha and Yonjan had filed the first petition claiming that mobilization of Nepal Army personnel was unconstitutional arguing that the army can be mobilized only through the decision of the National Security Council. However, a single bench of Chief Justice Kalyan Shrestha last week had quashed the petition during the very first hearing stating that the petition was premature and the Local Administration Act allows use of Nepal Army in 'aid of civil authority'.

Following the court decision, Jha and Yonjan again moved the court arguing that the provision of the act contradicts the Interim Constitution.

The Nepal Army has started patrolling streets in Tikapur of Kailali for security after a mob killed seven security personnel and a child in the district on Monday.
